Bail of R5000 for SANParks field guide accused of poaching

Mabunda’s bail application was motivated by his deteriorating health.
MBOMBELA – A SANParks field guide accused of rhino poaching was released on bail of R5 000 in the Nelspruit Regional Court on Tuesday.
Mr André Mabunda (44) faces various charges, hunting a protected species in the Kruger National Park, possession of a firearm and ammunition with the intent to commit a crime, unlawful possession of ammunition, conspiracy to commit a crime and the attempted theft of rhino horn.
Mabunda and his co-accused, Shakes Baloyi (47) and Laurence Baloyi (42), were arrested in the Kruger National Park on September 21 last year.
During their bail hearing on October 13, 2014, WO Willie Broodryk explained how the three were arrested. While police officials and SANParks rangers were patrolling the Lower Sabie area in a SAPS helicopter, they heard two shots being fired at about 10:00.
They saw a rhino carcass and landed for a closer look.
The rhino had been shot in the head. An axe was found nearby.
Broodryk testified that they followed tracks leading away from the scene and requested the assistance of SANParks’ Special Operations Team, which arrested Mabunda and Shakes Baloyi. Mabunda was wearing only his SANParks trousers. His shirt was later discovered close to the scene as were three cellphones.
A hunting rifle and cartridges, of which two had been fired, were also found in their possession.
“Shakes Baloyi later implicated himself by saying that he and Mabunda were dropped off at the scene by Laurence Baloyi,” Broodryk testified.
“The plan was that Mabunda would shoot the rhino. Shakes would saw its horn off. When Shakes didn’t want to remove the horn, Mabunda took off his shirt and removed the horn,” said Broodryk.
It was then that they heard the helicopter and ran away. Baloyi and Mabunda hid between bushes, where they were found and arrested. The three accused previously alleged that they were assaulted by the authorities who had arrested them.
Their bail hearing was consequently postponed last year and, when it continued, the state did not oppose Laurence’s bail application as he faced lesser charges than the other two.
Mabunda and Shakes’ bail applications were denied.
On Tuesday, a new bail application by Mabunda was motivated by his deteriorating health. The magistrate, Mr Andre Geldenhuys, stipulated that he will not be allowed in the Kruger National Park and may not consult with any of the state witnesses.
The case will continue on January 12 next year.
