All these para state attachments, that .gov now fosters, must
be seen as good, however will it be right????

Malpractice has set in thoroughly not doing the greater cause any
justice at all,..Did we really evolve from malpractice of the past???

Nationalism stinks, yet there is no replacement module guaranteed!!

The trial date of July 1 was confirmed in the poaching case against three SANParks employees who said they had been assaulted by the police during their arrest on September 21 last year. Mr André Mabunda (43), Mr Shakes Baloyi (46) and Mr Lawrence Baloyi (42) briefly appeared in the Nelspruit Regional Court on Wednesday. They were apprehended after they had been tracked down by the Skukuza SAPS and the special operations team close to where a rhino had been shot in the head. They are charged with hunting a protected species in the Kruger National Park, possession of firerams and ammunition with the intent to commit a crime, unlawful possession of ammunition, conspiracy to commit a crime and the attempted theft of rhino horn.

MBOMBELA – A former SANDF soldier and his co-accused briefly appeared in the Nelspruit Magistrate’s Court on Wednesday.

Mr Boet Leonard Mashego and Mr Michael Sithole were apprehended on September 19, 2010 after rangers in the Stolsnek area of the Kruger National Park came across a dehorned rhino carcass.

They found Mashego inside the fenced area of the park. Sithole was on the other side. According to a testimony from a game ranger who may not be identified, Mashego pointed his firearm in their direction and a shoot-out ensued.

Two rhino horns, two firearms and ammunition were apparently found in their possession. Mashego, who had been wounded during the shoot-out, was taken to hospital.

During a court appearance last year, defence attorney Mr Daniel Mabunda said, according to his clients, they were not poaching rhino. The defence version held that Mashego was on his side of the fence searching for his cattle, while Sithole was looking for herbs.

The accused face three counts of performing illegal activities in a national park, five of restricted activity involving a threatened species, five of theft, four of possession of an illegal firearm, and four of illegal possession of ammunition. They have also been connected with six other poaching cases.

Senior state advocate Ms Isabet Erwee confirmed that the case had to be postponed as the required state witnesses could not be present. The postponement date had not yet been confirmed.

SANDF soldier’s poaching trial – state closes its case
At the close of the state’s case, the accused applied for the charges against them to be dropped.

MBOMBELA – On Monday the state closed its case against former SANDF soldier Mr Boet Mashego, and Mr Micheal Sithole. They applied for the charges against them to be dropped. Their request was denied in the Nelspruit Regional Court.

Mashego and Sithole stand accused of poaching three rhinos and stealing their six horns on three different occasions. These crimes were allegedly committed in the Kruger National Park on June 10, June 22 and September 30, 2010.

It was testified that at 03:45 on the last date, game rangers encountered the two men in the Stolsnek area. They were positioned close to the park’s fence. When Mashego pointed his firearm in the rangers’ direction, a shoot-out ensued and he was wounded. According to testimony led during the trial, the two were arrested with rhino horns in their possession.

When the state closed its case, defence attorney, Mr Daniel Mabunda applied for his client, Sithole, to be discharged. Mabunda alleged that the state’s case against his client was fabricated. He added that they were innocent and that they were merely walking around in the area looking for herbs and cattle.

Senior state advocate, Ms Isabet Erwee’s counter argument held that the state had called numerous witnesses throughout the trial. She added that sufficient evidence had thus far been adduced against the accused to warrant the continuation of their trial.

The magistrate, Mr André Geldenhuys, postponed the case to October 15, when he would confirm whether the case against them would continue.

Bail of R5000 for SANParks field guide accused of poaching

http://lowvelder.co.za/302871/bail-of-r ... -poaching/

Mabunda’s bail application was motivated by his deteriorating health.

MBOMBELA – A SANParks field guide accused of rhino poaching was released on bail of R5 000 in the Nelspruit Regional Court on Tuesday.

Mr André Mabunda (44) faces various charges, hunting a protected species in the Kruger National Park, possession of a firearm and ammunition with the intent to commit a crime, unlawful possession of ammunition, conspiracy to commit a crime and the attempted theft of rhino horn.

Mabunda and his co-accused, Shakes Baloyi (47) and Laurence Baloyi (42), were arrested in the Kruger National Park on September 21 last year.

During their bail hearing on October 13, 2014, WO Willie Broodryk explained how the three were arrested. While police officials and SANParks rangers were patrolling the Lower Sabie area in a SAPS helicopter, they heard two shots being fired at about 10:00.
They saw a rhino carcass and landed for a closer look.

The rhino had been shot in the head. An axe was found nearby.

Broodryk testified that they followed tracks leading away from the scene and requested the assistance of SANParks’ Special Operations Team, which arrested Mabunda and Shakes Baloyi. Mabunda was wearing only his SANParks trousers. His shirt was later discovered close to the scene as were three cellphones.

A hunting rifle and cartridges, of which two had been fired, were also found in their possession.

“Shakes Baloyi later implicated himself by saying that he and Mabunda were dropped off at the scene by Laurence Baloyi,” Broodryk testified.

“The plan was that Mabunda would shoot the rhino. Shakes would saw its horn off. When Shakes didn’t want to remove the horn, Mabunda took off his shirt and removed the horn,” said Broodryk.

It was then that they heard the helicopter and ran away. Baloyi and Mabunda hid between bushes, where they were found and arrested. The three accused previously alleged that they were assaulted by the authorities who had arrested them.

Their bail hearing was consequently postponed last year and, when it continued, the state did not oppose Laurence’s bail application as he faced lesser charges than the other two.

Mabunda and Shakes’ bail applications were denied.

On Tuesday, a new bail application by Mabunda was motivated by his deteriorating health. The magistrate, Mr Andre Geldenhuys, stipulated that he will not be allowed in the Kruger National Park and may not consult with any of the state witnesses.

The case will continue on January 12 next year.
